Terms of Service

Introduction
These Terms of Service ("Terms") govern your access to and use of Lake Life, a service operated by Lake Life Digital LLC ("Lake Life," "Company," "we," "us," or "our"), including our websites, progressive web application, related domains, features, data, alerts, communications, and services collectively referred to as the "Service."

Please read these Terms carefully. By accessing or using the Service, creating an account, purchasing a membership, or affirmatively accepting these Terms when prompted, you agree to be bound by them.

If you do not agree to these Terms, do not use the Service.
1. About Lake Life
Lake Life is an informational platform designed for lake communities. Depending upon the lake and available data, the Service may provide information concerning lake levels, water conditions, trends, weather, bridge locations and estimated clearances, boat ramps and estimated ramp depths, points of interest, community information, alerts, recreational information, and other lake-related content.

Lake Life is an informational resource only.

Lake Life is not a marine navigation system, chartplotter, depth finder, collision-avoidance system, emergency warning system, emergency communication service, marine survey service, or substitute for official navigation charts, posted signs, buoys, markers, governmental warnings, weather services, or direct observation of actual conditions.
2. Acceptance of Terms
By using the Service, you acknowledge that you have read, understood, and agreed to these Terms.

Where Lake Life presents a safety acknowledgment, Terms acceptance screen, or similar notice, selecting "I Understand & Agree," "Continue," or similar affirmative language constitutes your agreement to the then-current Terms.

We may maintain records of the date, time, device, account, and version of the Terms accepted to document that acceptance.
3. Eligibility
You must be legally capable of entering into a binding agreement to use the Service.

If you use Lake Life on behalf of an organization, business, lake association, marina, government entity, or other organization, you represent that you have authority to bind that organization to these Terms.
4. Accounts
Most core Lake Life information may be available without an account.

If you create an account, you agree to provide accurate information and to maintain the security of your login credentials. You are responsible for activity occurring through your account.

You may delete your account through User Settings or other account-management features provided by Lake Life.

We may suspend or terminate an account when reasonably necessary to protect the Service, other users, Lake Life, or third parties, or when these Terms have been violated.
5. Membership & Payment
Lake Life may offer an optional paid membership that provides personalized or enhanced features in addition to freely available core information.

Unless otherwise stated at the time of purchase, Lake Life Membership is currently $10.00 per year and renews automatically each year until canceled.

Payments are processed by a third-party payment provider, currently Stripe. Lake Life does not directly store complete payment-card information.

Prices, membership features, and available plans may change. Any change affecting an existing recurring subscription will be communicated as required by applicable law before it takes effect.
6. Cancellation & Refunds
You may cancel an automatically renewing membership at any time through the available account-management tools.

Cancellation stops future renewal. Unless otherwise stated, you retain membership benefits through the end of the period for which you have already paid.

Membership fees are generally non-refundable once charged, except where required by law or where Lake Life determines that a billing error occurred.

Voluntary donations are generally non-refundable. If you believe a duplicate or erroneous charge occurred, contact support@ourlake.life.
7. Third-Party Data & Information
A substantial portion of the information presented through Lake Life originates with or depends upon independent third parties.

Depending upon the lake, these sources may include governmental agencies, utilities, hydroelectric operators, lake authorities, weather providers, mapping providers, environmental agencies, water-quality organizations, private data providers, and other sources.

Examples may include the United States Geological Survey, National Weather Service or other weather providers, Duke Energy, Cube Hydro Carolinas, Eagle Creek Renewable Energy, Open-Meteo, and similar organizations.

Lake Life does not own, operate, maintain, or control many of these underlying data sources, sensors, gauges, computer systems, networks, facilities, dams, waterways, bridges, boat ramps, weather stations, or monitoring systems.

The inclusion of information from a third-party source does not mean that the source sponsors, endorses, certifies, or guarantees Lake Life.
8. Data Accuracy, Delays & Availability
We work to present useful and accurate information, but we do not guarantee that information displayed by Lake Life is accurate, complete, current, uninterrupted, or error-free.

Information may be:
  • delayed at its original source;
  • delayed during transmission;
  • unavailable because of network, API, server, sensor, or software problems;
  • inaccurate because of equipment malfunction or reporting error;
  • incomplete;
  • outdated;
  • affected by configuration or programming errors;
  • changed or corrected by the original source after Lake Life receives it; or
  • inconsistent with actual conditions at a particular location.

Some Lake Life values may be derived or calculated values rather than direct measurements.

For example, an estimated bridge clearance or ramp depth may be calculated using water-elevation data together with reference measurements, elevations, or other stored information.

A calculated value is only as reliable as the underlying information and assumptions used to calculate it.

Displayed values should therefore be treated as estimates and informational guidance, not physical measurements or guarantees of actual conditions.
9. Lakes Are Dynamic Environments
Lake conditions can change rapidly and may vary significantly from one location to another.

Actual conditions can be affected by circumstances including, without limitation:
  • rainfall and runoff, drought, dam operations, generation schedules, planned or unplanned drawdowns, and flooding;
  • wind, waves, wakes from other vessels, currents, sedimentation, erosion, and dredging;
  • floating or submerged debris, fallen trees, and temporary obstructions;
  • construction, and changes to bridges, ramps, docks, or shoreline structures;
  • vegetation, vessel loading, equipment mounted on a vessel, and numerous other natural and human-made conditions.

No digital application can account for every condition occurring on a lake at every moment.

Actual conditions observed at the location always take precedence over information displayed by Lake Life.
⚠ 10. Bridge Clearances
Any bridge clearance displayed by Lake Life is an estimated clearance only.

You must never rely upon a Lake Life bridge-clearance value as confirmation that your boat or other vessel can safely pass beneath a bridge, utility line, structure, or obstruction.

Actual clearance can differ because of water-level changes, waves, wakes, vessel movement, measurement differences, bridge configuration, vessel loading, antennas, towers, canopies, outriggers, equipment, or other factors.

The vessel operator is solely responsible for: knowing the actual height and configuration of the vessel; observing the bridge or obstruction; assessing current conditions; maintaining an appropriate safety margin; and deciding whether passage can be completed safely.

If there is any doubt about adequate clearance, do not proceed.
11. Boat Ramps & Underwater Conditions
Boat-ramp depth, usable-ramp information, shoreline depth, and similar information displayed by Lake Life is approximate and informational only.

Actual water depth may vary substantially because of water level, ramp slope, sedimentation, erosion, dredging, obstructions, debris, changes to the ramp, vehicle configuration, trailer configuration, and localized underwater conditions.

Lake Life does not inspect ramps or underwater conditions before you use them.

Users are responsible for visually inspecting conditions and determining whether a ramp, access point, shoreline area, or body of water is suitable for their vehicle, trailer, vessel, equipment, and intended activity.
12. Weather, Hazards & Alerts
Weather, environmental, water-quality, drawdown, hazard, and other alerts or information available through Lake Life are supplemental informational features only.

Lake Life is not an emergency alert service.

An alert may be delayed, incomplete, unavailable, incorrectly displayed, or never received. The absence of a Lake Life alert does not mean that no dangerous or emergency condition exists.

You should maintain access to appropriate official sources of emergency information, including applicable governmental weather services, Wireless Emergency Alerts, local emergency-management agencies, law-enforcement authorities, lake authorities, and other official sources.

Never delay protective action while waiting for information or an alert from Lake Life.

In an emergency, contact 911 or the appropriate local emergency authority rather than attempting to communicate through Lake Life.
13. Navigation & Operator Responsibility
Nothing displayed by Lake Life authorizes or instructs a user to enter any area, operate a vessel under particular conditions, travel beneath a bridge, launch from a ramp, swim in a particular location, or engage in any particular activity.

The person operating a vessel remains solely responsible for the safe operation and navigation of that vessel.

That responsibility includes maintaining a proper lookout, controlling speed, observing actual conditions, avoiding collisions and hazards, complying with navigation rules and applicable law, obeying posted signs and markers, maintaining required safety equipment, and exercising appropriate judgment.

Lake Life should never be used while operating a vessel in a manner that distracts the operator or interferes with maintaining a proper lookout.
14. Assumption of Inherent Water-Related Risks
Boating, swimming, fishing, paddling, watersports, shoreline activities, and other recreational activities in and around bodies of water involve inherent risks, including serious bodily injury, drowning, property damage, and death.

By choosing to participate in those activities, you acknowledge that such risks exist independently of Lake Life.

Use of the Service does not transfer responsibility for evaluating those risks from you or the vessel operator to Lake Life Digital LLC.
⚠ 15. No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

LAKE LIFE DIGITAL LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, CURRENTNESS, RELIABILITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:
  • THE SERVICE WILL ALWAYS BE AVAILABLE;
  • DATA WILL ALWAYS BE ACCURATE OR CURRENT;
  • THIRD-PARTY DATA SOURCES WILL CONTINUE TO OPERATE;
  • ALERTS OR MESSAGES WILL ALWAYS BE RECEIVED;
  • CALCULATED VALUES WILL MATCH ACTUAL PHYSICAL CONDITIONS;
  • THE SERVICE WILL IDENTIFY EVERY HAZARD; OR
  • USE OF THE SERVICE WILL PREVENT ACCIDENT, INJURY, PROPERTY DAMAGE, OR LOSS.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
⚠ 16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAKE LIFE DIGITAL LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, LICENSORS, AND DATA PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS LIMITATION INCLUDES CLAIMS ARISING OUT OF OR RELATED TO:
  • inaccurate, incomplete, delayed, or unavailable data;
  • third-party data or services;
  • calculated or estimated information;
  • lake levels or water conditions;
  • bridge-clearance information;
  • ramp-depth or access information;
  • weather information;
  • water-quality information;
  • warnings or alerts;
  • failure to provide or receive an alert;
  • navigation decisions;
  • collisions;
  • grounding;
  • vessel or property damage;
  • personal injury or death;
  • interruption or failure of the Service;
  • software, communications, network, or equipment failures; or
  • reliance upon information presented through Lake Life.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAKE LIFE DIGITAL LLC'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID DIRECTLY TO LAKE LIFE DIGITAL LLC FOR USE OF THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
17. User Responsibility & Indemnification
You are responsible for your use of the Service and for decisions you make based upon information obtained through it.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Lake Life Digital LLC and its owners, members, managers, officers, employees, contractors, and affiliates from third-party claims, liabilities, damages, losses, and reasonable expenses arising from: your unlawful or improper use of the Service; your violation of these Terms; your violation of another person's rights; or information or content you submit through the Service.

This provision does not require you to indemnify Lake Life for liabilities that applicable law prohibits us from transferring to you.
18. Third-Party Services & Links
Lake Life may integrate with, display information from, or link to third-party websites, services, maps, payment processors, data feeds, or other resources.

Those third parties operate independently of Lake Life and may have their own terms and privacy policies.

We are not responsible for the availability, accuracy, security, practices, content, or performance of independent third-party services.
19. Intellectual Property
Except for content owned by third parties, Lake Life and its software, design, branding, graphics, organization, compilation, features, original content, and proprietary calculations are owned by or licensed to Lake Life Digital LLC and are protected by applicable intellectual-property laws.

These Terms provide you with a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purposes.

Except as permitted by law or authorized by Lake Life, you may not copy, scrape, reverse engineer, reproduce, redistribute, sell, commercially exploit, or create competing datasets or services from proprietary Lake Life content or functionality.

Third-party data remains subject to the ownership, licensing, attribution, and use requirements of its respective provider.
20. User Conduct
You agree not to:
  • use the Service for an unlawful purpose;
  • interfere with or disrupt the Service;
  • attempt unauthorized access to systems or accounts;
  • circumvent security or access controls;
  • introduce malicious code;
  • scrape or systematically harvest information except where authorized;
  • misrepresent your identity or affiliation;
  • use Lake Life information to create a false representation that Lake Life has certified a condition as safe; or
  • use the Service in a manner that creates an unreasonable risk to others.
21. Privacy & Data Use
Lake Life seeks to collect only information reasonably necessary to provide and improve the Service.

Guests may be able to use core features without identifying themselves personally. Lake Life may store device identifiers or similar technical information necessary to maintain preferences and provide functionality.

Members may provide information such as an email address, name, saved lakes, favorite locations, vessel information, preferences, and other account information.

Lake Life may use service providers where reasonably necessary to operate the Service, including payment processors, hosting providers, email providers, analytics providers, and similar vendors.

We do not sell or rent personal information to third parties for their independent marketing purposes.

Additional information concerning data practices may be provided through the Lake Life Data Notice or Privacy Notice.
22. Changes to the Service
Lake Life is continually evolving.

We may add, modify, discontinue, correct, or remove features, data sources, lakes, memberships, content, or functionality at any time.

We do not guarantee that any particular feature or third-party data source will remain available permanently.
23. Changes to These Terms
We may update these Terms from time to time.

The current version will be posted through the Service with an updated effective date.

For material changes, particularly changes concerning safety, payments, dispute resolution, or liability, we may provide additional notice or require renewed affirmative acceptance.

Your continued use of the Service after an update takes effect constitutes acceptance where permitted by law.
24. Termination
You may stop using the Service at any time.

We may suspend or discontinue some or all of the Service where reasonably necessary for legal, security, operational, or business reasons.

Sections that by their nature should survive termination — including intellectual-property provisions, warranty disclaimers, limitations of liability, indemnification, and dispute provisions — will survive.
25. Governing Law & Disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules, except where applicable law requires otherwise.

To the extent a dispute may lawfully be subject to an agreed forum, you and Lake Life Digital LLC consent to the jurisdiction of courts of competent jurisdiction located in North Carolina.

Nothing in this provision deprives a consumer of rights that cannot lawfully be waived under the law applicable to that consumer.
26. Severability
If a provision of these Terms is found unenforceable, invalid, or unlawful, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.
27. No Waiver
A failure by Lake Life to enforce a provision of these Terms does not waive our right to enforce that provision later.
28. Entire Agreement
These Terms, together with any applicable Privacy Notice, Data Notice, membership terms, and other policies expressly incorporated by reference, constitute the agreement between you and Lake Life Digital LLC concerning the Service.
